Before you decide to rent property from someone you need to be well aware of your rights. They can vary by location too so don’t assume you already know what they are due to being a previous renter. However, there are some basic things that come into play when you agree to rent property from someone. Even if those specific terms aren’t in the written agreement they are covered under the law.
There is a difference between wear and tear on a structure and damage that you have caused. This line needs to be clear because you don’t want to risk losing your security deposit. It is a good idea to walk through the property with the landlord prior to signing the lease. Document anything you see in the way of damages. For example if there is a broken door or a hole in the wall you need to describe the location. Ask the landlord to look over that document and to sign it. Then they can’t keep part of your deposit when you move out due to those types of damages. You can also take pictures of them with a digital camera that has a date stamp for the photos.
A tenant does have the right to privacy while renting from someone. In some locations it is acceptable for the landlord to come by for unannounced inspections of the property. If they have added this in the lease you sign then you are also agreeing to it. However, there are restrictions such as that they need to complete that inspection only when you are present. They can’t be in the property without your consent except in the event of an emergency. For example if they get a call from the person below you that water is leaking into their apartment they can go in and shut off the water from your location even if you aren’t home.
A tenant also has the right to live in a structure that is safe. This means that they have all of the basics they need including running water and electricity. If those are to be included in the rent then they must be provided. Also, the tenant has the right to ask for reasonable repairs at no cost to them. For example if the furnace isn’t working or a faucet is leaking then the landlord must take action to correct the problem after being notified.
If you feel that your rights as a tenant have been violated you can take action. You can find the tenant’s rights for any state listed online. However, it is a good idea to look at them before hand. That way you don’t get yourself involved in a situation by accident that could have been avoided. If you feel that you do have a case where your rights have been violated you can follow the proper procedure to file a case in a court of law.
